A Formal Regulatory Path: XGN Petitions the FCC for Voluntary 5G Broadcast Rules

For years, the technical feasibility of 5G Broadcast in North America has been proven through experimental authority, lab tests, and live tower demonstrations. This week, the conversation shifted from field trials to formal market authorization.
XGen Network (XGN), X1 Mobile, and Tyche Media LLC (licensee of experimental station WCRN-LD in Boston) formally filed a Petition for Rulemaking with the FCC. Led by Frank Copsidas, the filing asks the Commission to amend Part 74 rules, allowing Low Power Television (LPTV) operators to voluntarily deploy the 3GPP 5G Broadcast standard as an authorized alternative alongside ATSC 1.0 and ATSC 3.0.
If granted, this petition shifts 5G Broadcast from temporary experimental status into a permanent, commercially viable option for US broadcasters.
The Core Proposal Outline
The filing establishes a regulatory blueprint designed to deliver concrete operational, economic, and public safety outcomes for LPTV operators:
Mandatory Free-to-Air Linear Service: Stations adopting 5G Broadcast must maintain at least one free-to-air, linear video stream at 720p resolution or higher. This ensures operators satisfy local broadcast mandates while upgrading their core transmission technology.
Dedicated Public Safety Capacity: The proposal mandates that at least 50% of remaining channel capacity (and no less than 2 MHz of spectrum) be permanently dedicated to public safety applications. This opens direct viable pathways for sub-0.5-second emergency alerts, first-responder data casting and other mission-critical public safety applications
Protecting Multichannel Distributors: To prevent imposing technological burdens on pay-TV distributors, LPTV stations that qualify for mandatory carriage under FCC rules would be excluded from adopting 5G Broadcast.
Tailored Economics for LPTV: The filing explicitly highlights that ATSC 3.0 was designed with high-power, high-tower full-service economics in mind—imposing intellectual property licensing fees and hardware costs that can be prohibitive for LPTV operators. 5G Broadcast leverages the global 3GPP scale, lowering component costs and integrating directly into the standard mobile ecosystem.
By establishing a clear regulatory bridge, XGN’s petition aligns US spectrum policy with global 3GPP standards (such as Bands 112 and 113). Rather than relying on short-term special temporary authority, LPTV station owners gain a permanent framework to monetization: tapping excess capacity for data casting, supporting critical emergency communications, and delivering direct-to-mobile video—all while preserving public service at the core of broadcasting.
As manufacturers, public safety agencies, and network operators align on 5G Broadcast, formal FCC authorization would provide the regulatory certainty needed to drive commercial investment across US broadcast markets.
